So if the switch doesnt work and its stuck in vibrate mode, I think it might be stuck in vibrate.

Have you tried resetting it or restoring it?

I have a similar problem, but mine will toggle between the volume and vibrate, but when it's in the vibrate setting it won't vibrate and it's just silent. This just started happening recently. I dropped the phone a few months ago, but it still worked after that, so i'm not sure what this is.

I think this is an actual problem with the physical switch, not the software. My solution is a very crude one, but it seems to work. I just bang on the back of the phone a few times by slapping it into my other hand when holding it. Probably not advised, but it seemed to unjar the toggle and it works again. It definatley isn't a permanent solution because it happens from time to time.

It wont be covered under warranty because this happened because YOU dropped it. Human error.

It probably could be covered under warranty, only if you tell them it stopped working, and theres NO damage at all to that area.

And is it set to vibrate when the silent switch is on?

Haven't restored, but have reset a bunch of times. Yes, the vibrate setting is always the first thing i check before to make sure it's on before i start rapping the back of it.

Okay, and if there is no damage to your phone, this should be covered under warranty.

You should try taking it in to an Apple Store and see if they'll replace it...they will only if your warranty isnt expired though.

Is there any damage to your phone though? Around the same area as the switch? Dents or anything?
