my iphone is jailbroken or not??

Hi,
How do I know if my iphone is jailbroken or not??
And if it is broken what is the program I can use to download games or apps. (3rd party)

I bought it from a gay used it for 1 month and he get bored with it.

Right now it is :1.1.2 (3B48b)

If it is jailbroken you would use the Installer to load the 3rd party apps.
