so ive had the iphone v1 since december 07 can i upgrade

Unless you got a hookup at the AT&T store...

or... *whispering* you can get on a company account (you just need a Company number) which affords you upgrades ever YEAR...

you might be stuck with what you have... until December '09

iPhone v1 customers are eligible for discounted upgrades as the v1 price was unsubsidized. You should be able to get the $199/$299 prices.
