Well, that makes the contract illegal now doesn't it? Every cellphone owner in the US is legally allowed to unlock their phone if they have the capability.

IANAL but the illegality of one part of a contract does not necessarily invalidate the whole contract.

Maybe not (I was under the impression that it did but IANAL neither), but it certainly makes that one section null and void.
