Default $75 activation fee?

I called AT&T today and asked about my 2 lines.
Long story short, 1 line is eligible for the $199 price for 16 gig,
My existing line with an I phone that I bought last year a week after the 3 g was released is not eligible for even the $399.
I was told I need to pay full price PLUS a $75 upgrade/ activation fee.
How do I get the $399 price?

You don't usually pay activation unless you just started with ATT.
