The iPhone agreement also says Apple may monitor users' iPhones "to verify compliance with terms of this license."

IANAL but the illegality of one part of a contract does not necessarily invalidate the whole contract.

Maybe not (I was under the impression that it did but IANAL neither), but it certainly makes that one section null and void.
