The only surefire way I know of is having someone buy it for you in the countries that sell it unlocked...and they are expensive. If you know anyone that travels internationally or have a friend that can do it..you are in luck. A new 3GS purchased here...and if it has the updated firmware...even if you cancelled the contract after you bought it and got to keep the phone, is currently not unlockable. If you could find a 3GS with firmware 3.0.1 or less you could have it unlocked. I wouldn't trust ebay right now for a 3GS.

Search "which countries sell factory unlocked iphones" in google. They are much more expensive.

I work at an COR AT&T retail store...every COR store sells the iPhone without a contract! The iPhone's price is $499, $599 and $699 for the 3G, 16GB 3GS, 32GB 3GS respectively. Although you can buy them without a contract, they still must leave the store attached to someones account....of course you can take it off later.
