So about a week ago (8 days now) i bought my first Iphone 3g (16gb,White). As a side note, i owned the 2g Iphone since launch and used tmobile. My problem is this, when i first purchased the phone, i noticed that on ONE side of the phone, the silver bezel was much more raised than the other. Mind you its not BLATANTLY apparent, but if you rub your finger across it you can feel the lip, and i was having trouble getting cases to fit properly in addition to screen protectors. So today, i went into the apple store, and after an hour wait i met with a "genius" who didnt really believe there was a problem but said i could switch it out for a different one if i thought that one was better. He presented me with a phone and cosmetically it seemed fine ( no bezel issue ). I get home and take the plastic off and realize that this is NOT a new phone. WTF is that, i didn't drop 300 bones on a brand new phone just to get one with a defect, and have it replaced with some "Factory Serviced" phone. So i start looking over the new phone and the vibration toggle switch is INCREDIBLY difficult to "toggle", i mean painfully difficult just to get it onto vibrate and vice versa. I look further, and the sleep wake button is incredibly recessed into the phone (and tilting one direction), so much so that when i have my Incase Slider on it, its very very difficult to hit the button.
So here is what i'm thinking about doing. Is it possible for me to take the phone back to AT&T and return it, pay the restocking fee, and buy a new phone? Am i going to be looking at cancelation fees (I'm on a family plan with my wife)? I apologize for the novel and i appreciate any info your willing to share. Thanks, Paul

Sorry that happened to you, Paul.
Go complain to the "Genius" that helped you, and if he won't do anything, raise hell and speak to the manager... If the phone is under 30 days old, they have to give you another brand new phone.
Btw, the problems you were having with the bezel are semi-common. Even more common is a gap in between the screen and the chrome which shows some back-lighting and can let dust in. Watch out for that.

I wonder, is it really an explicit expectation that they have to replace my phone with another new one? Because if thats the case, i'll just go back in and raise hell :)

Well when you are outside of a certain time limit (often outside the return period) then you get a replacement with the knowledge that is most likely going to be refurbished. In your case however, as you were well within the 30 day return period, you should have been given a new phone.
As far as the ringer switch is concerned, there were a ton of complains about the button being too loose so I think Apple actually took an active movement and started to make them a bit more sturdy.

Ok so what do you guys think I should do? Should I go into the apple store and demand a NEW phone or go into the AT&T store and demand a new phone ( I did buy it at the AT&T store)?

That's a tough one... I think you should try the Apple Store, but they might blow you off because you didn't buy it from them. AT&T won't do anything, I think, because it's not the brand new phone you bought from them that you want to exchange. This is a tough situation you're in. :foot:

I would just go back to apple. They will exchange a iPhone just because you want to.

might as well go into the at&t store and raise hell, i know how i would handle this but it most likely isn't appropriate for the forum
