Non-Jailbroken Quake Submitted To App Store

iPhone Hacks (http://www.iphonehacks.com/2008/11/quake-app-store.html) is reporting that the developer who made Quake for the jailbroken iPhone has submitted another version of the game for the App Store. Here's a video of the non-jailbroken Quake game:

I wonder what the legal reprocussions would be, or if id software will charge them a percentage of the profit they make. Is the game still under copyright?
