Ok,
so here is what i dont understand. there are a TON of 3gs on ebay for sale. "unlocked" i dont understand that, but that is another issue.
I was eligable for an upgrade on my current contract so we ordered a 3G 8G Iphone.
Happy, right? well, no. Now my husband thinks that he has to have the 16G. ok ok. fine. but when I asked ATT if I could give the phone as a gift to someone, they said no. that the phone has to be activated to my phone line and that we would be paying the fee for it each month anyway.
How can i .... deactivate the phone off of my line and sell it on ebay? hopefully make enough to pay it off and some of the 16GB that i am supposed to order now.
Sigh.
please help me out. I am NOT a cell phone tech savy person. I figure there must be a way to do something like that or there would not be hundreds of them for sale on ebay.
Thanks alot!!!

Please some one able to help?
This is what I did. I sold my new iphone 3g 8 GB off ebay and got another one from apple but as I already got one at subsidized price so they sold it for 499 the 16 gb. I dont mind paying extra as I made enough selling off 8gb. They activated the new phone on my existing account. The only drawback is the second phone doesnt come with subsidy.
Hope this helps

Here's what you should do. Activate the phone for a minimum of 30 days. Cancel your account and pay the Early Termination Fee of ?$175, and then once you do that you are free to do whatever you want with the phone.
If its not activated within the 30 days, your contract states you will either have to return the phone, or pay the full retail price of the phone which is more than how much iPhone-V2 had to pay for his unsubsidized one, if I'm not mistaken.

Those at&t people didn't know what they were talking about.
The contract you signed to get the 8GB 3G iphone only applied to voice. You're free to sell or give away the phone anytime, and as soon as you do you will be able to cancel the data plan, you are just stuck in the voice contract for 2 years (unless you want to pay the fee to cancel early).
To buy an additional iphone you'll have to pay the higher price since you are no longer upgrade eligible (that price is $500 for the 16GB). But I'm sure you will get more then $500 for selling the first 3G iphone on ebay. Just make sure you KEEP the sim card.

Thank you all for your help. Now i know where to look. I will look into the voice contract and find out how much it is to cancel. as luck has it I do have another line eligable for upgrade, so maybe they will sell me a second one at a lower price.
Thanks again guys!!!

If you have another eligible line then yes you can get the lower price. Just tell them you want to buy the phone for that eligible line and then switch the numbers around (they shouldn't have any problem with it)

Tell your hubby to man up and just use the 8gb. It's a phone, not a storage decive. Just put on songs he is going to listen to and video's he is going to watch. Sync up the new songs and get rid of the ones he doesn't listen to. All that trouble for 8 more gig, not worth it.

What if he needs the extra space because he has a lot of movies or music, etc?

well the iphone was never meant to be a hold-it-all device like the ipod classics.
The idea is you sync it fairly often and when you do put on it what you might want to have in the short term, and then the next time you sync it changeo ut some of the music / movies.
I don't have much music (only 9GB) and I don't watch movies on it, so it isn't an issue for me

Yes but not everyone will/likes to have to re-sync different information all the time.
