You mean the Listen app by Erica Sadun I think. There is a licensing issue with her app's usage of the server it hits to get the song info - there's another thread on this somewhere, but her latest on her site says:
For now the Listen proof-of-concept is off-line. I applied to Gracenote a while ago for a developer license and have been waiting for them to respond. All further Listen development depends on the Gracenote licensing, who are probably off at CES and Macworld.

Pretty disappointing - was a very cool app - but sounds like it was way out of her price league ...
