the at&t memo specifically states that customer's that are eligible for an upgrade, and NEW activations (meaning if your a new customer or adding a line of service) will get the 199/299 pricing, except for customers that purchased the iphone before 5/27/08, they will automatically be eligible for an upgrade. The pricing for customer's that are not eligible for an upgrade (customer's that may have any other phone other than the iphone and have more than 8 months left in their current iphone contract) has not been set yet. There will not be a "no commitment" pricing, so when at&t figures out what to do for customers that are not eligible for an upgrade, every person that buys an iphone will have either renewed their 2 year contract or started a new 2 yr. contract.
